Electra Lamp Shop, Inc. does business as Compton's Lamps & Shades. We, meaning our corporation, operate a retail brick-and-mortar store in San Antonio, Texas. All references to our "store" below are references to the brick-and-mortar store.
Applicability of Terms and Conditions
Please review this information, including all the terms and conditions, before completing your order. By purchasing any item, or by placing an order to purchase any item, you expressly accept and agree to be bound by all of the policies, terms, and conditions disclosed on this website. We believe these policies, terms, and conditions are reasonable, but we ask that you read them carefully before you enter into any transaction with our brick-and-mortar store or our website.
Dispute Resolution: Jurisdiction, Venue, Waivers, Consent
Occasionally one of our suppliers makes a mistake—or we make a mistake—that inconveniences a customer. We try hard to prevent mistakes, and to do all we can to help fix those that happen. However, should you decide to resolve any dispute with us in a court of law or equity, you expressly agree to bring any suit, action, or proceeding solely in the district courts of Bexar County, Texas. To repeat, by your purchase you agree that for any controversy arising from your purchase or return of any item or items from our website, you understand and agree to:
- be subject to personal jurisdiction and venue in state district court in Bexar County, Texas;
- waive any right to remove the suit, action, or proceeding, or any portion thereof, to federal court;
- waive any right of special appearance or any other motion to avoid personal jurisdiction;
- waive any right to transfer venue outside of Bexar County, Texas; and
- consent to a motion to stay and abate any suit, action, or proceeding filed outside of Bexar County, Texas in any dispute resulting from your purchase or return and agree to pay our attorneys' fees to defend against any suit, action, or proceeding you bring in any jurisdiction other than state district court in Bexar County, Texas.
Free Shipping Only for Items You Keep
Some orders may include "free shipping." That means you will normally not have to pay for the items in that order to be shipped to you. However, if you return one or more items that were part of a free shipping order, we will reduce any refund amount you may receive by our cost to ship the items to you.
Privacy Policy
We respect the privacy of our Internet customers and we have instituted policies to insure your personal information is handled in a safe and responsible manner. Any information collected by us from you is for the sole purpose of providing you requested information, for the completion of sales transactions, or to inform customers of pending sales. We do not share or sell our customer information.
Return of Items Purchased at Our Store in San Antonio
You have 14 calendar days to return a purchase from our store. When you return or exchange a purchase made at our store, please bring with you the following items:
- your sales receipt,
- the item to return or exchange, and
- if your purchase was made with a card, the credit or debit card used for the purchase.

Inspect Your Order Immediately!
If you are present when the delivery is made, please ask the driver to note and report any damage you see on the boxes or packaging. THIS IS VERY IMPORTANT! If the packaging is visibly damaged, please ask the driver to stay for just a moment, unpack the item to see if it is broken or damaged, and if so, ask the driver to report the damage to his supervisor.
If you are not present when the delivery is made, please open and inspect your order for concealed damage or defects immediately upon receipt. Your item may be a gift for a much later date, but you must open and inspect your items now. If your item was damaged during transit, please call the carrier (e.g., FedEx, UPS) immediately and report the damage. Further, you must report all defects and damage to us on our form, and we must receive your written report by e-mail or fax within two calendar days of the delivery date.
Damaged or Defective Items
Please read the paragraphs on return of online purchases.
Do Not Remove Protective Wrap on Lamp Shades
Do not remove the protective plastic wrap from your lamp shades until you are sure you are keeping the lamp shades. Customers returning lamp shades without the shade's protective plastic wrap in place, or shades that have been unwrapped and re-wrapped, will be assessed a 25% restocking fee for each such shade. After you are sure you want to keep the lamp shades, please remove the plastic protective wrap before using the lamp.
Return of Online Purchases
We hope you will enjoy your purchase, but if you decide to return an item, you may do so subject to the following conditions.
- Delivery Date. In these policies, the delivery date means the date the carrier shows it delivered the item to you or the date you actually received the item, whichever is earlier.
- Non-returnable items. Not all items may be returned. Some items may not be returned because they were sold on a final sale basis; other items may be non-returnable items for any of the reasons listed in these policies.
- Particular items. Clearance items, close-out items, special order items, and mirrors are non-returnable items.
- Degraded items. If we ship you a new item that arrives undamaged, and the item is then degraded, meaning it is damaged, used, or installed in any way, the item is not returnable. To be a returnable item, the item must not have been used, installed, or damaged in any way. For example (for illustration and not for limitation), items that have been scratched, gouged, cracked, chipped, broken, or that have water spots, food stains, pet fur, tobacco smoke, or other contaminants in, on, or around them are non-returnable items. Lamp shades that have had their plastic wrapping removed may be, at our sole discretion, considered degraded items and thus become non-returnable items.
- Untimely action items. If an item is damaged or defective, we must receive, by e-mail or fax, your written report (using our form) of any defect or damage within two days of the delivery date. If you fail to do so, the item is a non-returnable item. Further, if you do not ship any item back to us within thirty days of the delivery date, the item is a non-returnable item.
- Returnable items. Subject to the other limitations in these policies, the following items are returnable items. Returnable items must be returned in their original packaging with all parts, bulbs, tools, manuals, accessories, etc. or a minimum 25% restock fee will apply.
- Stock items. Subject to the other terms, conditions, and limitations in these policies, items we ship from our stock or directly from the manufacturer are returnable items.
- Defective items. If an item has a gross manufacturing defect, even if it is a "particular item" as described in these policies, it is a returnable item if we receive, by e-mail or fax, your written report (using our form) of the defect within two calendar days of the delivery date. Please note that variations in color, finish, and texture are common in goods with hand finishes or hand-made components. These variations contribute to the hand-made character of the item, are not considered gross defects, and do not make the item defective.
- Damaged items. If an item is damaged in transit to you, please call the carrier to report the damage immediately. If the item was damaged during transit or by the manufacturer before or during the packing process, it is a returnable item if we receive, by e-mail or fax, your written report of the damage (using our form) within two calendar days of the delivery date.
- Subsequent degradation. If a stock item arrives damaged or with a gross manufacturing defect, but then sustains additional damage, use, or installation whether by act or neglect, the item becomes a degraded item as described in these policies, and is then, notwithstanding any other provision of these policies, a non-returnable item.
- Return Authorization. To return a returnable item, you must request and receive a Return Merchandise Authorization (RMA) number from us. You request an RMA number by completing our form and sending it to us by e-mail or fax. If you return a returnable item without an RMA number, we may, at our sole discretion, either refuse the returned item or accept the item but reduce the refunded amount.
- Return Shipping. You must ship the returnable item to us within 30 calendar days of the delivery date and we must receive it within 40 calendar days of the delivery date. You are responsible for the cost of shipping the item back to us and for any damage that may occur in transit.
- Refund Amount. If you comply with the requirements for returning a returnable item, your refund amount will be the sum of the price you paid plus the then-applicable sales tax less the sum of the cost of shipping, the cost of handling, any restock fee, any drop ship charge, and any cost to ship the item to you—even if you received the item on an order that was processed as "free shipping."

Waiver
We may choose to waive one or more of the requirements that apply to you in these policies because it seems to us like the right thing to do. However, even if we waive one or more provisions in these policies as pertaining to an individual item, all other provisions of these policies, including the provisions that were waived for an individual item, are still applicable to all other items except for those provisions expressly waived for a specific instance with a specific item.
Warranty
We warrant the items we sell to be free of gross defects in materials and workmanship. Thus, we will, at our sole discretion, repair or replace your item if it has one or more gross defects in materials or workmanship and you report any defect to us within 30 days of the delivery date. Please note that variations in color, finish, and texture are common in goods with hand finishes or hand-made components. These variations contribute to the hand-made character of the item, are not considered gross defects, and do not make the item defective. In addition to our 30 day warranty, most items also have a one year (from date of original purchase) manufacturer's warranty which may also apply. We honor all applicable manufacturers' warranties and will assist you in obtaining warranty support from the manufacturer. Neither our 30 day warranty nor the manufacturer's warranty covers repair or replacement of items that are damaged after the delivery date whether caused by any act or neglect.
